Letitia James won a $454 million judgment against Trump, his penalty for a decade of fraud. She and Trump are now fighting over her claims that he withheld evidence from her fraud probe. "The Court is well within its authority to determine if Defendants and their counsel facilitated that perjury by withholding of incriminating documents," James argued in Tuesday night's letter. AdvertisementAt a hearing in April of 2022, he compared getting Trump's documents to "pulling teeth." Out of some 900,000 documents turned over, only ten were "custodial" Trump documents, meaning business files in the former president's direct custody.

Donald Trump's fraud verdict targets three things he values dearly: his cash, his New York business address, and the Trump Organization steering wheel. Otherwise, as Engoron noted in his verdict, Trump, his company, and his sons, Donald Trump Jr. and Eric Trump, "are likely to continue their fraudulent ways." In previous years, Trump has settled allegations of fraud involving the Trump Foundation, Trump University, and the 2017 Inaugural Committee, Amer pointed out in closings. The same day James concluded her initial investigation and filed her massive Trump fraud lawsuit, on September 21, 2022, Trump incorporated "Trump Organization II" in what her office worried was an attempt to shift and protect assets. A Trump fraud-trial witness's possible perjury should not delay a verdict, NY officials argue. They say it's "hardly surprising" if Trump co-defendant Allen Weisselberg lied on the stand. Weisselberg "lacks credibility" anyway, the officials, from the NY AG's office, wrote Wednesday. "If true, he should be held to account fully for his actions," Wallace wrote of Weisselberg. NEW YORK (AP) — Lawyers involved in Donald Trump’s civil fraud trial told the judge Wednesday they had no information to share regarding a key witness reportedly negotiating to plead guilty to perjury in connection with his testimony in the case. The New York Times reported last week that Weisselberg was in negotiations with the Manhattan district attorney’s office to plead guilty to perjury and “admit that he lied on the witness stand” when he testified at the civil fraud trial in October. Wallace urged the judge not to delay the verdict, saying that doing so “would have the perverse effect” of rewarding Weisselberg and co-defendants, including Trump, for testimony that may have been false. Court officials have said Engoron's verdict in the case, which involves allegations Trump inflated his wealth to dupe banks, insurers and others, should be ready by mid-February. “Court decisions are supposed to be made based on the evidence at trial, not on media speculation," Kise said.

Trump's civil fraud trial, which could run him and Trump Org out of NY, is in its ninth week. A rep for Trump's biggest "victim," Deutsche Bank, testified Tuesday as an unlikely defense witness. AdvertisementDonald Trump's defense team tried to turn the tables at his civil fraud trial on Tuesday — calling a representative from his own biggest fraud victim, Deutsche Bank, to the witness stand in his defense. "We're expected to conduct due diligence and verify the information provided to the extent that's possible," the witness, Dave Williams, a Deutsche Bank managing director, told Trump's attorney Clifford Robert. Undaunted, Trump's side plans to continue Wednesday with direct examination of yet another Deutsche Bank official.

Reps from Deutsche Bank, which NY says was defrauded, described actually prospering thanks to Trump. Advertisement"We are whale hunting," former Deutsche Bank executive Rosemary Vrablic told her fellow bankers of Trump in an email from 2011, soon after son-in-law Jared Kushner offered to make an introduction. She contends that Deutsche Bank was defrauded out of more than $100 million in interest income. As a sophisticated international lender, the bank did its own risk analysis, apart from Trump's net-worth statements, the defense has argued. But the state has countered that any fact-checking, any profit-making, and any other non-victim-like behavior on the part of Deutsche Bank is besides the point.

He said accountants bear final responsibility for the net-worth statements Trump's on the hook for. When asked, the key defense witness could not estimate how much Trump is paying for his testimony. "How much of your bill has been paid and how much has not been paid," the judge asked. Engoron, in a pretrial decision, has already found Trump's net-worth statements were riddled with fraud. Testimony in Trump's defense case continues Friday.

An ex-SEC accountant offered blunt testimony on Trump's net-worth statements. He noted "questionable" and "glaring" issues with the statements, despite being Trump's own witness. The not-so-ready cash was just one of nearly a dozen net-worth red flags identified Wednesday by Flemmons. And it certainly happened a lot in Trump's net-worth statements, by Flemmons' own description. "Blame the accountants" has been one of Trump's go-to defenses in his New York fraud travails, going back to the criminal payroll tax-fraud case his company lost a year ago.

Judge Arthur Engoron sided with Donald Trump’s attorneys, overruling an objection from the New York attorney general’s office to admit a PowerPoint presentation showcasing the history of the Trump Organization. The presentation, titled “The Trump story,” also included photos of Donald Trump with his father, Fred Trump, as well as sleek photos of various Trump buildings. The PowerPoint included Trump's purchase of Mar-a-Lago in 1985, which Trump Jr. described as "one of the few sort of American castles." Assistant Attorney General Kevin Wallace objected to the presentation, claiming the text descriptions were coaching the witness. The judge has also sided with Trump's lawyers during the trial, but this signals the judge is going to give a lot of leeway to both sides in their presentation.

Ms. James has asked that Mr. Trump pay $250 million and that he and his sons be permanently barred from running a business in New York. Mr. Trump has denied all wrongdoing. Mr. Trump minimized the importance of the statements and said the banks paid little attention to them. During the first week of the trial, Justice Engoron ordered Mr. Trump not to comment on members of his staff, and put similar restrictions on his lawyers. On Wednesday, Mr. Trump’s daughter Ivanka will be the fourth and final Trump family member to testify.

Making the witness stand at his New York civil trial his podium, the former president laid into the presiding judge and the state attorney general who sued him. “He ruled against me without knowing anything about me,” Trump testified. Trump testified that he typically kept $300 million to $400 million in the bank, saying: “I’ve had a lot of cash for a long time." “They were not really documents that the banks paid much attention to,” Trump testified. “It was a sad, very sad thing," Trump testified.

When Mr. Kise said that the judge should want to hear from the former president, Justice Engoron disagreed, saying that many of Mr. Trump’s comments were irrelevant. Mr. Trump sat silent for a moment before resuming his testimony. For Democrats and others who have long fantasized about Mr. Trump getting what they saw as a comeuppance, that possibility was tantalizing. But after the midmorning break, the judge appeared less interested in cutting off Mr. Trump’s off-topic soliloquies. The judge explained why he was giving Mr. Trump more latitude: Mr. Wallace, he said, seemed to be happy with what he was getting from his combative witness.

Trump cried "fraud," falsely accusing the judge of valuing the property at $18 million. "The fraud is on the court when you rule that Mar-a-Lago is worth $18 million," Trump said. Trump and his allies have seized on that part of the opinion, falsely claiming that Engoron had personally valued Mar-a-Lago at $18 million. He said it's worth 18 million. Former U.S. President Donald Trump speaks on the day he attends the Trump Organization civil fraud trial, in New York State Supreme Court in the Manhattan borough of New York City, U.S., November 6, 2023. Engoron at one point said Trump’s answers were repetitive and irrelevant and warned that he might dismiss Trump as a witness, though that never came to pass. "You’ve made it important, but it wasn’t," Trump said in reference to the New York Attorney General's office that brought the case. "This is a very unfair trial, very, very unfair, and I hope the public is watching," said Trump, a Republican who has accused elected Democrat James of political bias. Trump Can’t Resist Turning Testimony Into Tirade

Trump, at times seemingly unable to stop himself from melting into a temper tantrum, claimed repeatedly, “It's election interference.”“We have a very hostile judge,” he said at one point. I wanted a jury.”To be clear, this particular type of case proceeding – determining damages in a civil fraud case – doesn’t use juries. That narrative is a markedly different one than Trump’s two adult sons provided in testimony last week. But Engoron already dismissed that defense in finding Trump liable for fraud. The defense team is expected to call many of the witnesses who have already testified, including Trump himself and his two adult sons.

The high-stakes civil case strikes at the heart of Trump’s brand – his real estate empire. New York Attorney General Letitia James is suing Trump for $250 million and seeking to bar him from doing business in the state. Trump’s attacks in a vacuum weren’t particularly remarkable – he’s used the same barbs throughout the course of the trial, which he’s attended repeatedly as a spectator. Trump’s rhetoric prompts an angry response from the judgeEngoron tried at the outset of Trump’s testimony to stop the former president from making speeches and instead answer the questions, but it did little to change Trump’s approach. “There’s a disclaimer clause where you don’t have to get sued by the attorney general of New York,” Trump said.

The judge in Trump's fraud trial lashed out, again, at his lawyer. Trump's lawyer, on Friday, asked permission to criticize her. AdvertisementAdvertisementA baffled, irked judge overseeing Donald Trump's family company's fraud trial in Manhattan criticized one of his lawyers again for his repeated attacks on his law clerk. "It's a shame you've descended to this level," New York Supreme Court Justice Arthur Engoron told Trump's lawyer Christopher Kise. Asked by a lawyer from the New York Attorney General's office what reporting Kise was talking about, the Trump lawyer was unsure.

On Friday, Trump's NY fraud-trial judge ruled Ivanka Trump must testify next week. Lawyers for the New York attorney general's office, who plan to call Ivanka Trump to the witness stand on Friday at their ongoing, $250 million Trump fraud trial, agree it was quite the deal. Her testimony at the non-jury trial could prove highly damaging to her father and two eldest brothers, Donald Trump, Jr., and Eric Trump – Trump Organization vice presidents who, like their father, are defendants in James' lawsuit. "Ivanka Trump tried to negotiate the number down to 2 billion," Wallace said in openings, "before agreeing to 2.5 billion." But during the same period, Donald Trump's net worth statements valued the exact same unit at $20.8 million.

New York (CNN) — Ivanka Trump must testify at her father’s New York civil fraud trial, the judge overseeing the case ruled on Friday. Ivanka Trump’s attorney had argued that she should not be forced to appear after an appellate court removed her as a defendant in the case. The judge also said Ivanka Trump should have submitted an affidavit asserting that she does not live or work in the state presently. Ivanka Trump was still identified by the New York attorney general’s office as a potential witness they could call in the case. Another Trump attorney, Cliff Robert, said Eric Trump is willing to be the corporate representative for the Trump Organization because he’s going to be testifying at trial anyway.

Members of the Trump family are scheduled to testify starting next week at a civil fraud trial in Manhattan, beginning with Donald Trump Jr. on Wednesday and concluding on Nov. 6 with former President Donald J. Trump. Mr. Trump and his adult sons, Donald Jr. and Eric, are defendants in the case, which was brought by New York’s attorney general, Letitia James. The former president’s daughter, Ivanka Trump, was a defendant but an appeals court dismissed the case against her this summer. Ms. Trump is still expected to testify next week after an unsuccessful effort on Friday to avoid doing so. In the lawsuit that led to the trial, Ms. James has accused the Trump family of fraudulently inflating the value of its assets to obtain favorable treatment from banks and insurance companies.
